Speak to one of them before you make any decision about your home.<\/div>\n<p>If you have missed a mortgage payment, the question in your head is almost certainly a numbers question: how many can I miss before someone takes my house? The honest answer is that the number people quote \u2014 three \u2014 is the wrong number to fix on. Three is roughly when a lender <em>becomes able<\/em> to go to court. It is not when you lose your home. Under the current rules, the gap between those two things is usually more than a year, and almost everything that matters happens inside that gap.<\/p>\n<h2>How many missed mortgage payments before repossession in the UK?<\/h2>\n<p>Three missed monthly payments is the usual trigger for court action. The convention dates back to a November 2008 agreement between the major lenders and the government not to start possession proceedings unless the borrower had accrued three months\u2019 arrears, and it has stuck. The Pre-Action Protocol<\/h3>\n<p>The <a href=\"https:\/\/england.shelter.org.uk\/professional_resources\/legal\/possession_and_eviction\/mortgage_possession_proceedings\/lenders_steps_before_court_action_for_mortgage_arrears\" rel=\"nofollow\">Pre-Action Protocol for Possession Claims based on Mortgage Arrears<\/a>, introduced by the Civil Justice Council on 19 November 2008, requires lenders and borrowers to try to reach an agreement before court. No proceedings should start while there is a real prospect of settlement. If your lender ignores it, the court can adjourn the case until it complies, and can penalise the lender on costs.<\/p>\n<h3>3. The Mortgage Charter<\/h3>\n<p>This is the protection most articles on this subject still miss. The Mortgage Charter, introduced in June 2023 and now signed by <strong>47 lenders representing roughly 90% of the UK mortgage market<\/strong>, commits signatories not to force a borrower to leave their home without consent, other than in exceptional circumstances, in <strong>less than 12 months from the first missed payment<\/strong>. FCA data shows that between July 2023 and March 2026, only <a href=\"https:\/\/www.fca.org.uk\/data\/mortgage-charter-uptake\" rel=\"nofollow\"><strong>342 properties<\/strong><\/a> were repossessed inside that window nationally.<\/p>\n<div class=\"note\"><strong>What this means in practice:<\/strong> if you missed your first payment last month, your home is not at risk this year, provided your lender is a Charter signatory and you keep talking to them. That is time you can use \u2014 to get advice, restructure the mortgage, or sell on your own terms rather than the court\u2019s.<\/div>\n<h2>How long does house repossession take in the UK?<\/h2>\n<p>Twelve to eighteen months from the first missed payment is the realistic range. The court stage alone typically runs three to six months: a claim is issued, a hearing is listed six to twelve weeks out, and if an order is made it usually gives 28 days.<\/p>\n<p>Most hearings do not end with you losing the house. Judges have wide discretion under the Administration of Justice Acts to suspend possession where the borrower can clear the arrears over a reasonable period, and a <strong>suspended possession order<\/strong> \u2014 you stay, and pay the normal monthly payment plus an agreed amount off the arrears \u2014 is the usual result where someone turns up with a workable plan. If you breach a suspended order, the lender applies for a warrant, and bailiffs must give you at least 14 days\u2019 notice of the eviction date. It is that lenders repossess a very small number of homes because repossession is slow, expensive and loss-making for them. They would nearly always rather agree something with you. That gives you more negotiating room than most people in arrears believe they have.<\/p>\n<h2>What should I do first if I have missed a mortgage payment?<\/h2>\n<p>Two things, in this order, and both within days rather than weeks.<\/p>\n<ol>\n<li><strong>Call your lender before they call you.<\/strong> Ask specifically about a temporary interest-only period, extending the term, a payment deferral, or capitalising the arrears. Partial payments are recorded, count in your favour at a hearing, and slow the arrears down. And do not ignore court paperwork \u2014 not attending a hearing is the single fastest route to an outright possession order.<\/p>\n<h2>Can I sell my house if I am in mortgage arrears?<\/h2>\n<p>Yes. You can sell at any point up until the property is taken into possession, and often after a possession order too, if the court agrees to postpone eviction because a sale is genuinely progressing.
