What Is the Land Registry and How It Influences Home Ownership and Transactions

First created in 1862, Her Majesty's Land Registry is a governmental department that registers and safeguards property and land ownership in England and Wales. Employing approximately 4.700 people in 14 locations across England and Wales, the Land Registry currently safeguards land and property worth more than £4 trillion, including £1 trillion worth of mortgages.

Scotland and Northern Ireland have equivalent offices. Scottish land and property ownership records are kept by the Registers of Scotland, whereas Northern Irish records are kept by the Land and Property Services.

Homeowners and the Land Registry

If you're not currently registered with the Land Registry, you must do so to buy or sell land or property or take out a mortgage. The Land Registry will then decide how the land should be registered legally.

Once registered, HM Land Registry provides homeowners with a land title that is backed by the government. In addition, the Land Registrywill keep a historical reference of individual property ownership, updating details each time the property is exchanged. This includes any changes to mortgages and leases. Homeowners can also do a Land Registry search to discover historical property ownership details of any home in England or Wales.

The Benefits of HM Land Registry

Establishing proof of property ownership, the Land Registryprovides definitive documentation that you own the property or land you claim to. This simplifies conveyancing, meaning that any property transactions cam be completed with ease, and with less costs for everyone involved.

All title information is stored on the Land Registry database. Homeowners can access their title deed information at any time. All information is 100% secure.

As the Land Registry is a state-backed governmental department, homeowners have greater security of title. This protects homeowners against any claims of false possession.

The Land Registry and Title Deeds

If you're a joint property owner and your partner passes away, homeowners do not need to contact the Land Registryto change the title deeds. Instead, homeowners can choose to complete a DJP (Deceased Joint Proprietor) form to transfer the ownership rights from joint to sole ownership.

Should you be without your Title Deeds, or if you've misplaced the deeds to your home, the Land Registry can provide you with copies.

To get a copy of your Title Deeds, you will need to visit the Land Registry portal. The cost to attaining Title Deeds does vary in price from £19.95 - £39.95. Basic title deeds cover property registration and a basic title plan and cost £19.95 to attain. Comprehensive Title Deeds are priced at £39.95 and guarantee that official copies of every document held by the Land Registry will be referred to the Title Register.

Conveyancing and The Land Registry

In almost all cases of property exchange, managing legal property ownership paperwork, including registering with the Land Registry is handled by either a professionally-trained conveyancer or a solicitor.

To own any property legally, it's paramount that all Land Registry and conveyancing forms are completed meticulously, in full accordance with the law. Failure to do so, may result in further complications with actual title ownership being questioned.

With any property transaction involving a mortgage, the lender will always request that a solicitor or experienced conveyancer handle the transaction, including the completion of Land Registry documentation. Failure to provide evidence of this may result in the mortgage lender not approving a mortgage.

All Land Registry documentation will be exchanged between conveyancers or solicitors via post. This is to protect the personal and financial details of both parties. If you've received an email claiming to be from your conveyancers or solicitors asking for payment for any aspect of your conveyancing, always contact them to ensure its authenticity.

With more than 230 properties sold each month, Springbok Properties expert conveyancers can help you with every aspect of your conveyancing, including Land Registry documentation. Call us TODAY on: 0800 068 7935 to find out more.
